SCHOOL IMPACT-FEES

The Home Builders Association of Metro Orlando's lawsuit against Osceola County challenged the way it calculated an increase in the school impact fee. In May 2004, the county had raised the fee 234 percent to $9,708 per single-family home from $2,828. However, in a win for Osceola County, Circuit Judge R. James Stroker upheld the basic methodology in a September ruling, though his final ruling in December orders the county to credit builders $2,100 per home for revenue tied to certificates of participation. The credit is equivalent to $10 million of the $45 million that has been held in escrow since the lawsuit was filed. Now that the case has been resolved, $35 million -- which is the difference between the old and new fees -- can be released from escrow and put toward school construction projects.
